Multi-Million Pound Victory For Medical Negligence Case

Howells Solicitors

26 Jun, 2024

After many years of litigation, Mr. A* and his family have finally won a substantial compensation claim for medical negligence, thanks to Howells Solicitors. With the help of Senior Solicitor Jenna Kisala and the Howells medical negligence team.

Mr. A was awarded Ā£3 million in damages after losing his vision and suffering mobility issues due to a delayed diagnosis of tuberculous meningitis at Rotherham District General Hospital and Sheffield Children’s Hospital.

In December several years ago, Mr. A, a healthy young boy, began experiencing nausea, headaches, high fever, and rashes. His GP initially misdiagnosed the symptoms as a virus and prescribed antibiotics. Over the next 10 days, his condition worsened, leading to multiple hospital admissions and treatments.

On Christmas Day, Mr. A was readmitted to Rotherham District General Hospital. The following day, he was transferred to Sheffield Children’s Hospital.

In the ICU, Mr. A became unconscious and partially paralysed. An MRI revealed fluid on his brain, requiring emergency surgery. Two weeks later, he was diagnosed with tuberculous meningitis. By the following January, he had suffered permanent optic nerve damage and was registered blind five months later.

The following year, Mr. A’s mother instructed Howells Solicitors to pursue a compensation claim for medical negligence.

The legal process spanned many years due to the complexity of medical evidence from six independent experts. The Claimant’s experts argued that timely anti-TBM treatment would have likely resulted in a complete recovery, while the Defendants’ experts disagreed.
In February 2024, a settlement was reached without an admission of liability with Mr. A being awarded £3 million in damages.

Now 25, Mr. A suffers from permanent mobility issues affecting his right hand, lower limb, and face, along with severe visual impairment. Despite attending school and college, he requires daily assistance and faces significant employment challenges due to his disabilities.

Senior Solicitor Jenna Kisala commented, ā€œTuberculous meningitis is rare, but the delays in the medical review and treatment at both hospitals led to Mr. A’s life-altering injuries. Anyone affected by incorrect or delayed diagnoses should contact us to discuss support for a compensation claim.ā€

Mr. A said “I’m grateful for the support and perseverance of Howells Solicitors. They kept me well informed throughout the process and helped me reach the results that I wanted and needed.”
