What is Extradition? 

Extradition is the formal process of requesting the member state to remove a person from one country to another. It is either to prosecute them for an offence or to impose a sentence for an offence of which the person has already been convicted.

 

What is the Extradition Process?

The extradition process begins when a country formally requests for a person to be returned. If the country is within the European Union, the National Crime Agency (NCA) will receive and review the request and where appropriate issue a warrant for the requested person. For countries not in the European Union, the Home Office are responsible for receiving the extradition request. 

There are two types of warrant which can be issued, the first is that the requested person must be returned to face prosecution, and the second is where the requested person has already been convicted and must be returned to serve their sentence. Once the warrant is issued, they will be arrested and brought to Westminster Magistrates Court. 

Once they are at the Magistrate’s Court, the requested person will be able to have a solicitor with them.
