Conveyancing Solicitors Frequently Asked Questions

How long will my sale and purchase take?

You usually need 8 to 12 weeks from the acceptance of an offer until you can move in or out of your home.

It can be quicker or slower, depending on the parties in the chain. If you are a first-time buyer, buying a new build property can take time. If you have a mortgage in principle, it may take 8 to 12 weeks. This is true if the property is ready.

If you are buying a leasehold property that needs a lease extension, this can take much longer. It is hard to estimate because it depends on many factors. For example, it depends on whether the landlord has agreed to the extension. It will usually take between 3 and 6 months.

What is the difference between joint tenancy and tenants in common?

Joint tenancy is a type of joint ownership where multiple owners have equal rights and shares in a property. In tenancy in common, the co-owners can have unequal shares of the property.

In joint tenancy, each owner has an equal share. In tenancy in common, each tenant can own different parts or percentages of the property. We have created a comprehensive advice guide Joint Tenancy or Tenants in Common: What’s the Difference?

What is Stamp Duty?

Stamp Duty is a tax you might have to pay if you buy a residential property. You will pay Stamp Duty on residential properties costing more than £125,000. However, you may qualify for first-time buyers’ relief.

When do you pay conveyancing fees?

You pay conveyancing fees a couple of days before exchange or completion. Prior to this, your conveyancing solicitors will request their legal fee and all disbursements.

What is the first thing to do when moving into a new home?

Make sure to redirect any important mail as soon as you can. Also, update your driving license with your new address. We also recommend taking meter readings and informing all utility providers you have moved house.
